Relationships between the legal and the alternative in terms of conflict resolution in the 21st century

Towards a culture of peace

Abstract

The essential purpose of the present contribution is to place the issue of the relationships between alternative methods of dispute resolution and the Law and try to place in spaces of light what until now had remained somewhat in the shadows due to the all-out defense that some do one method and others do the other on the path towards a culture of peace in modern society. The bibliographic review of the current doctrine on the subject, the synthesis and the analysis allow us to reach a thesis about the possible alleviation of social conflict. A solid reference is identified, framed and contextualized that could be useful to legal operators and operators of alternative methods of conflict management and resolution in their mission to alleviate the heavy burden that current conflict represents. There is still a lot of experience to be gained in terms of the development and improvement of alternative dispute resolution mechanisms and, furthermore, in finding new directions within the eminently legal ways to deal with human conflicts. An interesting door opens to link the inveterate justice system with the meta-legal aspect of the alternative, with these methods that transfer the point of balance in the treatment of controversies to the protagonists of the conflict themselves and facilitating effective negotiation between them. Close relationships have been found that can reduce the filing of matters in the Courts and, ultimately, the society of the 21st century gains in civility, taking another step in its essential humanism.
