The protection of the legal good of the environment in the Spanish Penal Code is dispersed and is carried out using a poorly refined legislative technique. Crimes in this matter, configured as blank criminal norms, frequently lack a minimum content of disvalue that legitimizes the intervention of criminal law in this area, causing its administrativeization. This, together with an excessive breadth in the configuration of typical behaviors and the lack of precision in their wording, makes it difficult to delimit the scope of application of the different precepts, ultimately hindering their operation.
